TikToke Terms of Service

INTRODUCTION
These Terms of Service (the “Terms”) constitute a legally binding agreement between you and TikToke, and govern your access to and use of the TikToke platform — including all associated services, applications, web and mobile interfaces, embedded experiences, and digital environments operated by, branded as, or made available through TikToke — whether such access occurs as a casual visitor, a registered account holder, a verified store operator, or any other category of user that the Platform may from time to time recognize. These Terms apply in conjunction with the Privacy Policy and any feature-specific terms or policies referenced from within the Platform, and they should be read together as a single, coherent governance framework rather than as discrete or severable documents.
By accessing, registering for, or otherwise using the Platform in any manner — whether by viewing publicly available content, creating an account, placing or coordinating an order, participating in engagement features, or interacting with the Platform's automated systems — you affirm that you have read these Terms, that you understand their content and effect, and that you agree to be bound by them in their entirety. If you do not agree with any portion of these Terms, your sole remedy is to immediately discontinue use of the Platform; continued use following any modification or republication of these Terms constitutes ongoing acceptance of the version then in force.
OPERATOR IDENTITY AND DOMAINS
TikToke is owned and operated by NetBics. References to TikToke, the Platform, we, us, or our refer to the NetBics-operated service experience unless a feature-specific notice identifies a different responsible operator.
NetBics may use related domains, including netbics.com, netbics.app, netbics.ca, TikToke regional domains, and other owned or authorized aliases, to route users to the appropriate website or app experience. NetBics may later make netbics.app the primary app domain, with netbics.com forwarding to that app surface and regional domains used where appropriate for location-aware routing before users are handed off to the app experience.
ELIGIBILITY
You represent and warrant that you meet, and will continue to meet for the duration of your use of the Platform, the legal age requirement for cannabis-related access in the Province or Territory in which you reside or from which you access the Platform, and that you are otherwise legally permitted under applicable federal, provincial, and municipal law to engage with the discovery, browsing, and order-coordination functionality made available through the Platform. Where your jurisdiction imposes additional eligibility conditions — such as identity verification, residency, or registration with a regional cannabis authority — you further represent that you have satisfied each such condition before accessing the relevant areas of the Platform.
Misrepresentation of eligibility, including the use of false age information, false residency declarations, or any attempt to circumvent the Platform's age- and location-gating mechanisms, constitutes a material breach of these Terms and may, at the Platform's sole discretion, result in immediate suspension or termination of access, the invalidation of any associated account state, and the referral of relevant information to the appropriate regulatory or law-enforcement authority where required by applicable law.
PLATFORM ROLE
TikToke operates solely as a discovery, engagement, and coordination platform, and acts as an intermediary between users and the independent third-party store operators that have chosen to make their offerings available through the Platform's surfaces. TikToke does not itself sell cannabis products, does not manufacture, formulate, package, or otherwise produce any cannabis goods made discoverable through the Platform, and does not act as a licensed distributor under any applicable federal or provincial cannabis-control regime.
The Platform's role is limited to the presentation of store and product information, the coordination of orders initiated by users, the facilitation of communication between users and the relevant store, and the provision of ancillary engagement features such as referrals, rewards programs, and gameplay experiences that complement — but do not replace — the underlying transactional relationship between the user and the store. Every transaction coordinated through the Platform occurs between the user and an independent third-party store operator that bears sole responsibility for the lawful sale, fulfillment, age-verification, packaging, delivery, and post-sale support of the products it offers. Nothing in these Terms, in any user-facing copy, in any marketing material, or in any operational notification published through the Platform should be construed as creating a buyer-seller relationship between TikToke and the user, an employment or agency relationship between TikToke and any independent store operator, or any obligation on the part of TikToke to perform a regulated activity reserved by applicable law for licensed sellers, manufacturers, or distributors.
USER OBLIGATIONS
As a condition of access to the Platform, you agree to comply with a small number of foundational obligations that are essential to the lawful and good-faith operation of the service. You agree to provide the Platform with information that is accurate, complete, and current at the time of submission, and to update such information promptly upon any material change, including changes to your contact details, residency, or eligibility status; the accuracy and currency of submitted information directly affects the Platform's ability to deliver appropriate functionality and to comply with its own legal obligations.
You further agree to comply with all applicable federal, provincial, and municipal laws and regulations that govern your use of the Platform, including, without limitation, laws relating to the purchase, possession, and consumption of cannabis products, laws relating to the protection of minors, and laws relating to consumer fraud and electronic communications. You agree to use the Platform in good faith and for lawful purposes only, including the lawful coordination of personal-use orders, the participation in engagement features as intended, and the constructive use of communication channels exposed by the Platform.
You further agree to refrain from any conduct that is fraudulent, abusive, deceptive, harassing, exploitative, or designed to circumvent the Platform's security, anti-fraud, or rate-limiting controls, and you acknowledge that the Platform may suspend or terminate access in response to such conduct without prior notice where such immediate action is necessary to protect the Platform, its users, or third parties.
TRANSACTIONS AND LIABILITY
Because TikToke acts solely as a discovery, engagement, and coordination platform, TikToke does not assume responsibility for the underlying products, services, or fulfillment activities provided by independent third-party store operators through the Platform. Without limiting the generality of the foregoing, TikToke does not assume responsibility for the quality or authenticity of any cannabis product made discoverable through the Platform, including but not limited to its potency, purity, accuracy of labeling, freshness, packaging integrity, or compliance with regulatory standards established by the relevant provincial or federal authority.
TikToke does not assume responsibility for delivery timelines or delays, including the accuracy of estimated-delivery indicators displayed in the order experience, the punctuality of any assigned delivery agent, or the impact of weather, traffic, demand surges, or other operational factors that may extend or shorten the actual delivery interval beyond any displayed estimate. TikToke does not assume responsibility for the conduct or actions of independent store operators or their agents, including but not limited to fulfillment errors, communication failures, refusal to fulfill an order, or any commercial dispute that may arise between the user and the operator in connection with a coordinated transaction.
All such disputes must be resolved directly between the user and the relevant store operator, and the user expressly acknowledges that the Platform's role is limited to providing reasonable coordination assistance — such as the surfacing of relevant order information or contact channels — and does not extend to acting as an arbiter, guarantor, or insurer with respect to any underlying commercial relationship.
REWARDS AND TOKE BUCKS
Toke Bucks and any related rewards, credits, badges, in-product currencies, or engagement incentives offered through the Platform are designed to enhance the entertainment and discovery value of the experience, and are subject to the operational and integrity controls described in this Section. Toke Bucks possess no monetary value and no redeemable cash value; they are not legal tender, are not transferable outside of the contexts explicitly enabled by the Platform, are not refundable upon account closure, and confer no proprietary right capable of being asserted against TikToke or any third party.
The Platform may at any time, in its sole discretion, modify the rate at which Toke Bucks are earned or redeemed, suspend the issuance of new Toke Bucks, retire or migrate existing Toke Bucks to a successor incentive system, or revoke Toke Bucks held by an individual account where revocation is reasonably necessary to address suspected manipulation, abuse, or breach of these Terms. All Toke Bucks balances are subject to the Platform's anti-abuse, anti-fraud, and system-integrity controls, and the Platform reserves the right to invalidate any Toke Bucks that have been obtained through manipulation, exploitation, automated participation, the operation of multiple accounts in coordination, or any other conduct that the Platform reasonably determines to be inconsistent with the intended use of the rewards system. Where Toke Bucks are revoked, modified, or invalidated under this Section, the Platform's determination is final, save for any rights of review or recourse expressly granted under applicable consumer-protection legislation.
CONTENT SUBMISSIONS
From time to time, users may be invited or required to submit content through the Platform — including but not limited to photographic images, brief textual descriptions, or other media — typically in support of order verification, dispute resolution, or feedback mechanisms designed to improve the user-facing experience. Where such content is submitted, the user grants TikToke a non-exclusive, royalty-free, worldwide license to use, store, and process the content for the purposes for which it was submitted, including the operation of internal review workflows, anti-fraud assessments, and the improvement of related verification systems.
Users agree not to submit content that is illegal under any applicable Canadian federal, provincial, or municipal law, including but not limited to content depicting illegal sales, illegal possession, or any conduct prohibited by applicable cannabis-control or consumer-protection legislation. Users further agree not to submit content that contains personally identifiable information of third parties without the demonstrable consent of those third parties — including images of identifiable individuals, identification documents, or correspondence — and not to submit content that is misleading, fraudulent, or otherwise designed to deceive the Platform's automated or human review processes.
All submissions may be reviewed, retained for the period reasonably required for the purpose of submission, rejected, removed, or referred to the appropriate authority at the Platform's sole discretion, and users acknowledge that submission does not entitle them to any guaranteed acceptance, retention, or display of the submitted content. Where content is removed or refused, the user remains free to seek remedy through the underlying transactional relationship with the relevant store operator where applicable.
CAPTURE FEATURES AND GENERATED ITEM LICENSE
Where the Platform offers features that allow a user to capture clothing, fit, or fashion-oriented media through the device camera and have that material processed into a digital wearable item, an avatar asset, or a related Platform-internal artifact, the user grants TikToke a non-exclusive, royalty-free, worldwide license to use, store, transmit, transcode, process, analyze, review, and otherwise handle the submitted footage and any artifacts derived from it for the operational purposes of the relevant feature, including but not limited to moderation review, authenticity assessment, the generation of corresponding 3D wearable items, and the improvement of related capture and generation systems.
Users represent and warrant that they are authorized to capture the footage they submit through any Platform capture feature, including, where the captured material includes the likeness, voice, or distinctive personal attributes of a person other than the submitting user, that they have obtained the demonstrable permission of that person prior to submission. Users further agree that they will not use any Platform capture feature to record private documents, residential addresses, identification documents, identifiable minors, or sensitive third-party content. The Platform reserves the right to reject, moderate, remove, redact, or disable access to any submitted footage and any 3D wearable item, avatar asset, or other artifact generated from that footage, where doing so is reasonably necessary to enforce these Terms, the Privacy Policy, or applicable law, and the Platform's determinations under this Section are final save for any rights of review expressly granted under applicable consumer-protection legislation.
ACCOUNT ENFORCEMENT
In order to maintain the safety, integrity, and lawful operation of the Platform, TikToke reserves a broad set of enforcement rights with respect to user accounts and the access privileges associated with them. The Platform reserves the right to suspend or terminate any user account, with or without prior notice, where suspension or termination is reasonably necessary to address conduct that violates these Terms, conduct that may compromise the safety of other users or third parties, conduct that may expose the Platform to legal or regulatory risk, or conduct that the Platform reasonably determines to be inconsistent with the intended use of the service.
The Platform reserves the right to restrict or revoke access to specific Platform features — including but not limited to ordering functionality, engagement features, rewards systems, and gameplay surfaces — where such restriction is necessary to mitigate the risk of abuse or to enforce eligibility requirements. The Platform further reserves the right to remove, modify, or refuse to publish any user-submitted content that violates these Terms, that fails to satisfy applicable content guidelines, or that the Platform reasonably determines to be inconsistent with the lawful operation of the service.
Such enforcement actions may occur without prior notice where the Platform reasonably determines that immediate action is necessary to protect the Platform, its users, or third parties from imminent harm; in all other cases, the Platform endeavors to provide a brief, written explanation of the action taken so that the affected user may, where appropriate, request review under any applicable internal appeal mechanism or seek recourse through external means provided by law.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, the Platform is provided to users on an “as-is” and “as-available” basis, without representation or warranty of any kind, whether express, implied, statutory, or otherwise, in connection with the operation, availability, accuracy, completeness, or fitness for a particular purpose of any feature, surface, or piece of information made accessible through the Platform.
Without limiting the generality of the foregoing, TikToke specifically disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability, and disclaims any liability for loss of profits, loss of goodwill, loss of data, business interruption, or any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of, or inability to use, the Platform — even where the Platform has been advised in advance of the possibility of such damages. Where applicable consumer-protection legislation imposes warranties or liability that cannot lawfully be disclaimed in their entirety, the Platform's liability shall, to the maximum extent permitted by such legislation, be limited to the smallest measure permitted by law, and any remedies available shall be limited to the remedies expressly contemplated by the relevant legislation.
MODIFICATIONS
TikToke may amend, supplement, or otherwise update these Terms from time to time in order to reflect changes in the Platform's functionality, evolutions in the legal and regulatory environment in which the Platform operates, or shifts in industry-standard governance practice. When a material amendment is made, the Platform will, where reasonably practicable, surface an in-product notification or banner identifying that the Terms have been updated and providing a direct link to the revised version, so that users have a meaningful opportunity to review the new terms before continuing to use affected functionality. Continued use of the Platform following the publication of any amendment to these Terms constitutes the user's acceptance of the revised Terms in their entirety; users who do not accept an amendment may discontinue use of the Platform and exercise any account-deletion rights then available.
GOVERNING LAW
These Terms, the relationship between the user and TikToke established by these Terms, and any dispute or claim arising out of or in connection with these Terms or the use of the Platform shall be governed by, and construed in accordance with, the laws of Canada and the laws of the Province or Territory in which the user resides at the time of the relevant interaction, without regard to any conflict-of-laws principle that would direct the application of the law of another jurisdiction. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction located in the relevant Province or Territory, save for those disputes that applicable law reserves to a specialized administrative tribunal or to an alternative dispute-resolution mechanism otherwise mandated by federal or provincial legislation.
